1. Acceptance of Terms
By accessing or using ClutchSnap (the "Service"), operated by ClutchSnap LLC, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use the Service.
2. Description of Service
ClutchSnap is a parent-controlled platform for youth sports memories. Parents and legal guardians create player profiles for their children, upload photos and videos to a private family gallery, share selected media to private team galleries visible to that team's families and staff, track live games and statistics, and, where a parent explicitly chooses, approve and email a private weekly story to a loved one, make a child's profile discoverable, or invite family members to follow it. Team coaches, managers, and invited team staff may also upload media to team galleries under the roles and consent controls described in the Service.
Service limits. ClutchSnap is built for photos and video clips, not full-length game recordings. Each video file must be 500 MB or smaller. Your plan sets how much video you can store and how long a single clip may be. We may change these figures without changing these Terms, so the revision date above does not fix them. The limits that apply to you are shown where you upload.
3. Eligibility & User Accounts
The Service is for adults (18 or older). Creating an account requires attesting your birth year. Before sharing a child's information beyond your own account, you confirm that you are the parent or legal guardian. ClutchSnap does not offer accounts to children; children's information is added and managed exclusively by a parent or legal guardian through the parent's own account. When you register on behalf of a minor, you confirm that you are that child's parent or legal guardian with authority to do so.
You must provide accurate information when creating an account, and you are responsible for maintaining the security of your credentials and for all activity that occurs under your account. Accounts are personal: you may not share your credentials, and you may not create or operate multiple accounts to evade usage limits, privacy controls, a suspension, or a prior termination. Notify us immediately at support@clutchsnap.com if you suspect unauthorized use of your account.
4. Your Content & License
You (or the person who took the photo or video) retain all ownership rights in the content you upload. By uploading content, you grant ClutchSnap a limited, non-exclusive, worldwide, royalty-free license to host, store, resize, transcode, and display that content for the purpose of operating and providing the Service (for example, generating thumbnails, streaming video, showing media in the galleries you choose to share it to, and, when you send one of your own share links, letting the messaging app you send it with show a preview picture of it) and, only where the content features a child whose own parent has opted that child into the promotional showcase, to use it in ClutchSnap's own marketing as described in Section 6 of the Privacy Policy. This license ends when the content is deleted from the Service, subject to the removal timelines in our Data Retention Policy.
A YouTube or Vimeo video you add by link is content you are responsible for, in the same way as a photo. We ask that service whether it can be watched here; we do not check what it contains. A clip you save from another service and add from your phone is a video you upload, and the same rules apply as for any video.
By uploading content you represent that:
- You own the content or have permission from its owner to upload it;
- For content depicting your own child, you are the child's parent or legal guardian;
- For content depicting other children (for example, team photos), you upload it in good faith under your team's consent arrangements. Team galleries are private to that team's families and staff, and any parent may ask us to remove content depicting their child at any time.
We may remove content that violates these Terms, fails our content-moderation review, or that a parent asks us to remove in respect of their child. We never sell your content and never give it to third-party advertisers. Content appears in ClutchSnap's own marketing only when it features a child whose own parent has explicitly opted that child into the promotional showcase (Section 6 of the Privacy Policy). That parent can withdraw the opt-in at any time, and an uploader can withdraw their content from marketing use by deleting it or contacting support@clutchsnap.com. See the Privacy Policy for how content and personal information are handled.
We use contracted providers to help deliver and protect the Service. Our Privacy Policy explains what information they receive and why. Our Data Retention Policy describes retention and deletion. This doesn't transfer ownership of your photos or videos.
5. Children's Privacy & Parental Consent
ClutchSnap offers no accounts to children and never knowingly collects information from a child. A child's personal information is added by their parent, or by their team's adults in a team gallery, and stays under the control of the child's own parent or legal guardian, as described in Section 1 of our Privacy Policy. We apply the protections of the Children's Online Privacy Protection Act (COPPA) as our own standard. New player profiles are private by default. Features that share a child's information beyond the parent's own account (team gallery sharing, private family stories, public or discoverable profiles, and follower invitations) require the parent confirmation described there. The parent can revoke sharing at any time. Optional AI features, where offered, require separate opt-in from the parent.
6. Payments, Subscriptions & Trials
Parts of the Service are free; certain features require a paid subscription. All prices are shown before you confirm a purchase.
- Payment processing. Payments are processed by our third-party payment processor (Stripe). ClutchSnap never receives or stores your full card number.
- Subscriptions auto-renew. Paid subscriptions (billed monthly or annually) renew automatically at the end of each billing period until canceled. You can cancel at any time from your account settings; cancellation takes effect at the end of the current billing period, and you keep access until then.
- Trials never auto-convert. If you receive a free trial of paid features, the trial simply ends on its end date and your account returns to the free plan. We do not automatically start charging you when a trial ends.
- Price changes. If subscription prices change, the new price applies from your next billing period, and we will notify you in advance of any increase.
- Refunds. Except where required by law, payments are non-refundable; if you believe you were charged in error, contact support@clutchsnap.com and we will review your request.
7. Acceptable Use
Personal use only. The Service is offered solely for the personal, non-commercial use of parents, legal guardians, and the team staff they authorize, through the interfaces we provide. Any other use, including any commercial use, requires our prior written permission.
You agree not to misuse the Service. In particular, you will not:
- Upload content you do not have the right or permission to upload;
- Attempt to access, scrape, or redistribute photos, videos, or profiles of children you are not authorized to view;
- No scraping or bulk extraction: access the Service with any crawler, scraper, bot, headless browser, or other automated tool, or harvest, bulk-download, or systematically extract any data or content from the Service, without our prior written permission;
- No reverse engineering: reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, structure, or non-public APIs of any part of the Service, or probe or test its security other than through a disclosure you have agreed with us in writing, except to the extent applicable law prohibits this restriction;
- No taking data out without permission: copy, republish, resell, license, or otherwise make content or data from the Service available to any third party, other than your own family's data through the sharing and export tools we provide;
- No third-party integrations: connect the Service to, or make it interoperate with, any third-party product, service, or API, or build any product, service, or dataset on top of it. We do not offer a public API, and no vendor or partner integration exists unless a written agreement signed by us says so;
- No AI training: use any content or data from the Service to train, fine-tune, or evaluate any machine-learning or artificial-intelligence model;
- Circumvent or attempt to circumvent privacy settings, consent controls, sharing entitlements, rate limits, or other security measures;
- Harass, threaten, or harm other users, or submit abusive or inappropriate content or messages;
- Impersonate another person or misrepresent your relationship to a child or team;
- Use the Service for any unlawful purpose.
We may investigate suspected violations of this section. Violations may result in immediate suspension or termination under Section 11, and we reserve every remedy available to us at law or in equity, including claims under applicable anti-hacking and computer-misuse statutes.
No inappropriate content. Content posted to any shared surface — a team gallery, a player profile, or the Home feed of families who follow a player — must be appropriate for a youth-sports audience that includes children. You may not post content that is sexual, sexualizing of a minor, nude or partially nude, violent or gratuitously graphic, hateful, harassing, or that identifies a child in a way their parent has not agreed to. Content that breaks this rule may be reported by any parent who can see it and may be removed from shared galleries and feeds when it is flagged, as described in Section 8.
8. Reporting & Content Moderation
Every parent can act on what they see. On the Home feed and in team galleries you can remove your own posts at any time, stop following a player so their content no longer reaches you, and report a post you believe is inappropriate.
- Reporting. A reported post immediately disappears from the reporting parent's own feed, whatever we later decide about it. Reports are reviewed by a person. We do not tell the family who posted the content who reported it.
- Removal when flagged. A post is hidden from all shared galleries and feeds while we review it when it is reported for a child-safety reason (including a parent reporting that their own child is pictured without their agreement), or when multiple people independently report it. Uploads are also scanned automatically, and content that fails that scan is never published. No automated scan identifies everything, which is why reporting exists.
- What removal means. Removal from shared surfaces does not delete the original from the uploading parent's private gallery — only sharing is stopped. We notify the parent who posted it, and they may appeal to support@clutchsnap.com. If a review confirms the content breaks these Terms, it stays removed and we may also act on the account under Section 11.
- Abuse of reporting. Reporting exists to protect children, not to settle disputes between families. Repeatedly filing reports in bad faith is itself a violation of these Terms.
- Content about your child. Separately from reporting, a parent or legal guardian may ask us at any time to remove content depicting their child, and we will do so. Contact support@clutchsnap.com.
We may remove content, hide it pending review, or limit an account without prior notice where a child's safety is at stake. Where we act, we tell the affected parent what happened and how to appeal.
9. Our Intellectual Property & Feedback
The Service itself, including its software, design, text, graphics, logos, trademarks, and everything else that is not content uploaded by users, is owned by ClutchSnap LLC or its licensors and is protected by intellectual-property laws. These Terms grant you a limited, revocable, non-exclusive, non-transferable right to use the Service for the personal purposes described in Section 7, and no other right or license. You may not use the ClutchSnap name or logo without our written permission.
If you send us suggestions, ideas, or other feedback about the Service, you agree we may use it without restriction or compensation. Feedback never includes your family's photos, videos, or personal information, which remain governed by Section 4 and the Privacy Policy.
10. Copyright & DMCA
We respect intellectual property rights and respond to copyright infringement notices under the Digital Millennium Copyright Act. To report infringement, or to file a counter-notification, follow the process on our DMCA page. We maintain a policy of terminating the accounts of repeat infringers in appropriate circumstances.
11. Suspension & Termination
You may stop using the Service and delete your account at any time from your account settings; deletion follows the timelines in our Data Retention Policy.
We may suspend or terminate any account, with or without prior notice, for any violation of these Terms or any abuse of the Service. That includes, without limitation:
- Sharing account credentials, or creating or operating multiple accounts to evade usage limits, privacy controls, or a prior suspension or termination;
- Breaching or circumventing usage limits, rate limits, or plan entitlements;
- Uploading or sharing unlawful content, including any image or video that sexualizes or exploits a minor. We remove such content, preserve it as the law requires, and report it to the National Center for Missing & Exploited Children and to law enforcement where the law requires or permits;
- Scraping, automated access, reverse engineering, or any other violation of Section 7;
- Providing false information about your identity or your relationship to a child or team;
- Payment fraud, including chargebacks made in bad faith;
- Any other conduct that puts children, other users, or the Service at risk.
We act especially quickly on violations that put children's safety or privacy at risk. Where reasonable, we will notify you and give you an opportunity to export your data; we may withhold notice where the law requires it, where an investigation could be compromised, or where a child could be put at risk. Amounts already paid are not refunded on a termination for cause, except where the law requires otherwise. Sections 4 (as to content already shared), 7, 9, 12, 13, 14, and 16 survive termination.
12. Disclaimers & Limitation of Liability
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. Photos, videos, and other content on the Service are provided by users, and we do not endorse them; responsibility for uploaded content rests with the person who uploaded it, subject to the moderation described in Section 8. We may add, modify, suspend, or discontinue features of the Service at any time; if a change materially reduces a paid feature, we will notify you and you may cancel under Section 6.
To the maximum extent permitted by law, ClutchSnap is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, and our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose. Nothing in these Terms limits liability that cannot be limited by law.
13. Indemnification
You agree to indemnify and hold harmless ClutchSnap LLC and its officers, employees, and agents from any claim, loss, or expense (including reasonable attorneys' fees) brought by a third party and arising out of content you upload, your violation of these Terms, or your violation of any law or of any right of another person, including another family's rights in respect of their child. This obligation does not apply to the extent a claim arises from our own breach of these Terms, and it does not limit any consumer right that cannot be waived.
14. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Nothing in this section deprives you of protections you are entitled to under the consumer-protection laws of the place where you live.
- Talk to us first. Before filing any claim, you agree to contact us at support@clutchsnap.com and give us 30 days to try to resolve the dispute informally.
- Binding arbitration. Any dispute not resolved informally will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small-claims court, and either party may seek injunctive relief in court for infringement or misuse of intellectual property or for violations of Section 7 (including scraping and unauthorized data extraction).
- Class action waiver. Disputes will be resolved only on an individual basis. Neither you nor ClutchSnap may participate in a class action, class arbitration, or representative proceeding against the other.
- Opt-out. You may opt out of arbitration and the class waiver by emailing support@clutchsnap.com within 30 days of first accepting these Terms, stating that you opt out of arbitration.
- Venue and time limit. Any claim that proceeds in court will be brought in the state or federal courts located in Orange County, California, and both parties consent to that venue. Except where the law does not allow it, any claim must be filed within one year of the events giving rise to it.
15. Changes to Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or in-app notice before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
For accounts created before September 1, 2026, the sections added on that date (Sections 9, 13, 14, and 16, and the expanded Sections 7 and 11) take effect only after we have given that notice and 30 days have passed; until then, the previous version of those sections applies to you. Accounts created on or after September 1, 2026 accept these Terms as written.
16. General
These Terms, together with the policies they link to, are the entire agreement between you and ClutchSnap LLC about the Service. If any provision is found unenforceable, the rest remain in effect, and the provision will be enforced to the maximum extent permitted. Our not enforcing a provision is not a waiver of it. You may not assign these Terms or your account; we may assign these Terms in connection with a merger, acquisition, or sale of assets, in which case the Privacy Policy's commitments continue to apply to data already collected. Neither party is liable for delay or failure caused by events beyond its reasonable control. Provisions that by their nature should survive the end of these Terms do so, as listed in Section 11. We may send notices to the email address on your account.
